Terms and Conditions

Last updated: 2024

These Terms and Conditions ("Terms") govern the use of the website and the provision of email marketing services by Lazupo. By accessing this website or engaging our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our website or services.

1. Who We Are

This website is operated by Lazupo ("we", "us", "our"), based at:

Lazupo
108 Broadway Market
London, N1 6LH
United Kingdom

You can contact us using the following details:

Lazupo provides email marketing services for businesses, including campaign design, audience segmentation, deliverability support and performance reporting for client organisations operating in the United Kingdom and elsewhere.

2. How an Order Is Placed and Confirmed

Services are engaged either through a written proposal accepted by the client, or via an order form submitted through this website. An order is considered placed once a client has submitted the required details (company information, service scope and preferred package, where applicable).

No contract exists between Lazupo and the client until we send a written confirmation by email to the address supplied, accepting the order and setting out the agreed scope of work, fees and estimated timeline. We reserve the right to decline any order at our discretion, for example where the requested service falls outside our capacity or where the intended email content does not comply with applicable law.

3. Prices, Payment and What Is Included

Prices for our services are quoted in the proposal or order confirmation sent to the client and are exclusive of VAT unless stated otherwise. VAT will be added at the applicable rate where required by law.

Unless otherwise agreed in writing, our fees cover the specific deliverables listed in the order confirmation (for example: campaign strategy, template design, list segmentation support, or scheduled sends). Costs for third-party tools, sending platforms, or paid advertising placements are not included unless expressly stated.

Payment terms, invoicing schedule and accepted payment methods will be set out in the order confirmation or a separate service agreement. Late payment may result in suspension of ongoing work until outstanding amounts are settled.

4. Cancellation and Complaints

Clients may request cancellation of an order by written notice to [email protected]. Where work has already commenced, we reserve the right to charge for services performed up to the date of cancellation.

Consumers ordering services for purposes outside their trade or profession may, where applicable, have a statutory right to cancel within 14 days under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. This right may be lost once performance of the service has begun with the consumer's express agreement and acknowledgement that the cancellation right will be lost upon completion.

If you are unhappy with any aspect of our service, please contact us at [email protected] or by phone at +44 20 7741 3286. We will investigate and respond to complaints promptly and in good faith, aiming to resolve issues directly wherever possible.

5. Limitation of Liability

To the fullest extent permitted under the laws of England and Wales, Lazupo shall not be liable for any indirect, incidental or consequential loss, including loss of profits, loss of business opportunity, or loss of data, arising from or in connection with the services provided.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law.

Our total liability for any claim arising out of or in connection with the services shall not exceed the total fees paid by the client for the specific service giving rise to the claim.

6. Cookies

This website sets a single cookie, named consent_state, which stores your cookie consent choice for a period of one year. No analytics, tracking or session cookies are used on this website. Advertising measurement, where applicable, only runs after you have given consent, and only on the confirmation page following a completed action.

You can manage or withdraw your consent at any time through the cookie settings available on this website, or by clearing cookies in your browser.

7. Data Protection

We process personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. For details on how we collect, use and protect personal data, please refer to our separate Privacy Policy.

If you believe your data protection rights have not been respected, you have the right to lodge a complaint with the Information Commissioner's Office (ICO), the supervisory authority for data protection in the United Kingdom.

8. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

9. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services or legal requirements. The updated version will be posted on this page with a revised "Last updated" date. Continued use of our services after such changes constitutes acceptance of the revised Terms.
